Tribunal abondonment order
Instead of issuing an Abandonment Termination Notice the lessor or agent can apply directly to the Tribunal for an abandonment order.
The Tribunal can make an order declaring the premises were abandoned on a certain date. If the Tribunal makes an abandonment order, the lessor or agent can also request an order for compensation.
If you wish to dispute an abandonment order you have 28 days from the date of the original decision to apply to the Tribunal for a review of this decision.
If your application is successful, you can seek compensation for any costs you incurred as a result of the termination of your tenancy.
If you abandon the premises, the lessor can apply to the Tribunal for compensation for their financial loss. If your tenancy is terminated due to abandonment and the amount that you owe is greater than the bond, this is grounds for the lessor to list your details on a tenancy database.
